3.2.5 Board Dismissal

The governing board has a policy whereby members can be dismissed only for appropriate reasons and by a fair process.

Narrative of Compliance

Texas A&M University System Board of Regents members are appointed by the Governor of Texas and confirmed by the Texas Senate [1]. As appointees of the Governor, the Board of Regents are state officers and are subject to laws that regulate state officers. Board members are protected by state law from being dismissed without appropriate reasons and by an unfair process. Dismissal of state officers requires impeachment proceedings which include due process protections and can only take place for cause. The impeachment proceedings are outlined in Texas Government Code 665 Impeachment and Removal [2]. As noted in section 665.002(3), impeachment proceedings specifically include "a member, regent, trustee or commissioner having control of a state institution" [3]. The University has no record of impeachment proceedings for a Board of Regents member.
